Resultado:

The Court modified the parties’ existing equal parenting time schedule to award Father primary residential custody of the minor child, with Mother’s parenting time reduced to every other weekend. Prior to this modification, the parties shared equal parenting time. In his petition, Father requested that the equal schedule be changed so that he would serve as the child’s primary residential parent, with Mother exercising parenting time on an every‑other‑weekend basis. The Court agreed with Father’s position and modified the parenting schedule accordingly, replacing the prior equal arrangement with a schedule under which Mother now has parenting time every other weekend.

Antecedentes y datos clave:

The parties shared equal parenting time for a number of years. However, as the child grew older, his needs changed and routine and consistency became paramount to his well‑being, particularly in light of a documented downturn in his academic performance and diminished ability to participate in extracurricular activities. After considering these changes and the evidence presented at trial, the Court determined that Father was the parent better able to provide stability for the child, based on multiple documented factors admitted into evidence demonstrating Father’s capacity to support the child’s educational progress and consistent engagement in his activities.

CASO / Estrategia:

At Father’s request, the child was interviewed by the Court to ascertain his current environment in both homes, as well as his wishes regarding ongoing parenting time and legal decision‑making. The purpose of this request was to ensure the Court had sufficient information to make accurate findings as to the child’s preferences, which, under Arizona’s best‑interests’ framework, is one of the factors the Court must consider when determining legal decision‑making and parenting time.

Repercusión en el cliente:

Father has been positively impacted by the Court’s decision, as he is now able to more closely oversee the child’s academics and social activities than was possible under the prior equal time‑sharing arrangement.

Por qué es importante esta victoria:

As a result of the Court’s decision, the child is now positioned in an environment that better supports his ability to thrive both academically and socially, while still maintaining frequent and meaningful parenting time with Mother.
