Petitioner and the minor child resided in another country, where litigation had already been commenced to address
Child Support, parenting time, and legal decision-making authority. Despite the pending proceedings abroad, Petitioner sought competing orders in Arizona concerning the same issues. Through the Arizona proceedings, we successfully challenged Petitioner’s attempt to obtain duplicative relief and argued that the existing foreign proceedings should be respected. The Court declined to allow competing litigation to proceed in Arizona and recognized the jurisdictional concerns created by the pending foreign matter. This outcome prevented the entry of conflicting orders and allowed the parties’ existing litigation concerning the minor child to proceed in the appropriate jurisdiction.
